Trump Administration Urges Supreme Court to Lift Deportation Block

(MENAFN) On Saturday, Washington urged the U.S. Supreme Court to overturn its emergency order that temporarily suspended deportations under the Alien Enemies Act. The administration's motion aims to lift the stay that was put in place following an urgent appeal from the American Civil Liberties Union (ACLU).

Solicitor General D. John Sauer urged the justices to lift the stay in a recent court filing, allowing lower courts to address the matter. According to reports, Sauer criticized ACLU attorneys for "improperly skipping over the lower courts" and labeled their petition as "fatally premature." Sauer emphasized that the government had provided migrants with "adequate time to file" legal challenges and assured that individuals with pending claims would not be deported.

The ACLU's emergency appeal to the Supreme Court underscored the serious risks faced by detained Venezuelan migrants, warning that they could face life sentences in a Salvadoran mega-prison without judicial review if deported.

Previously, the Supreme Court had directed the government "not to remove any member of the putative class of detainees" until further instructions were provided. Justices Clarence Thomas and Samuel Alito reportedly expressed dissent regarding this order.

The ongoing legal dispute focuses on migrants detained in the Northern District of Texas, which falls under the jurisdiction of the Supreme Court's directive. Additionally, federal courts in the Southern District of New York, the District of Colorado, and the Southern District of Texas have implemented temporary injunctions against deportations linked to the act.

Last month, the Trump administration utilized the 1798 Alien Enemies Act to initiate the deportation of over 100 migrants, marking its unprecedented application outside of wartime. Officials maintain that the act is relevant due to what they describe as a continuous "invasion" by the Venezuelan gang Tren de Aragua.

On Friday, the ACLU reported that another wave of deportations was underway, with migrants being moved to airports, prompting urgent legal actions in various courts.
