Homeland Security Chief Addresses Habeas Corpus Suspension

(MENAFN) During a congressional hearing on Wednesday, U.S. Homeland Security Secretary Kristi Noem suggested that the current level of unauthorized migration along the southern border might warrant suspending habeas corpus — a legal protection that permits individuals to contest their detention in court.

When asked whether the situation could be deemed an “invasion” sufficient to justify such a move, Noem responded, "I'm not a constitutional lawyer, but I believe it does."

She clarified that the matter lies outside her authority, stating, "This is something that's not in my purview to weigh in on. This is the president's prerogative, and he has not indicated that they will or will not be taking action."

Her testimony followed comments made days earlier by senior White House advisor Stephen Miller, who told journalists that the Trump administration is "actively looking at" the possibility of suspending habeas corpus as part of broader immigration enforcement efforts.

During the hearing, Democratic members confronted Noem about the wrongful deportation of Kilmar Abrego Garcia, a Salvadoran citizen removed from Maryland and sent to a large detention center in El Salvador.

They also questioned her regarding the recent expulsion of two American-born children by the Trump administration.

In response, Noem defended the government's actions, saying, "We have utilized due process as it’s laid out in the tools Congress has given us."

She further emphasized that in the case of the deported minors, the responsibility rested with their parents, stating that the children’s mothers had voluntarily chosen to bring them along.
