ECHR Condemns Denmark for Turkish Inmate’s Death
This decision, reported by a national broadcaster, represents a landmark verdict as it is the first instance in which Denmark has been held accountable by the ECHR for violating this fundamental human right.
According to Tobias Stadarfeld Jensen, who represented Sahin, the court’s decision reflects a critical failure on the part of Danish authorities.
Jensen stated, “They lacked control over the risk posed by their use of force and were not adequately updated on proper procedures. This judgment is a significant defeat for Denmark, a country that considers itself advanced in prison management.”
His remarks underscore the broader implications for the nation’s penal system and the need for reforms in the treatment of detainees.
The judgment referenced Articles 2 and 3 of the European Convention on Human Rights, which safeguard the right to life and forbid cruel or degrading practices.
The ruling focused on assertions made by Sahin’s mother, Mrs. Kalkan, who argued that prison officers had not received appropriate instructions regarding the use of leg lock restraints.
The method, applied to Sahin for a prolonged 13 minutes, was judged to be unnecessarily harsh.
The court aligned with the family’s claims, stating that prison personnel had not been given sufficient guidance on using chest-down leg lock restraints and that their training in such methods was lacking.
This lack of preparation was seen as a key factor in the tragic incident.
Ekrem Sahin, who was 23 at the time, fell unconscious during the incident and was transferred to Odense University Hospital.
After remaining in a coma for three days, he died—only half a year before he was due to be released from custody.
