US border agents ordered to pause deportations under Trump asylum prohibition
According to two Department of Homeland Security officials, the internal order was issued over the weekend after an appeals court lifted a stay on a lower court’s ruling. That ruling determined that Trump’s broad asylum ban violated US laws requiring the government to consider protection claims from migrants fearing persecution or torture if returned to their home countries.
While the appellate court upheld the president’s authority to limit asylum access in certain cases, it reaffirmed that the US must honor legal protections under the United Nations Convention Against Torture and domestic laws that prevent sending individuals to countries where they could face harm.
Customs and Border Protection (CBP) officers were instructed to follow standard immigration procedures, including reviewing asylum claims and other humanitarian protections, the report added.
Officials will now increasingly use expedited removal, a faster deportation process that still allows migrants to request asylum if they can show a credible fear of persecution.
In a statement to CBS News, CBP said the ruling affirmed “the President’s authority to deny asylum to aliens participating in an invasion into the United States,” but emphasized that illegal border crossings will continue to result in prosecution and removal “to the fullest extent of the law.”
